What can I do if an organisation does not respond to my request for access?
Did you not receive a response from an organisation to your request for access within 1 month? Then you can contact the DPO or privacy officer of the organisation, if the organisation has one. You will find the contact details of this person in the privacy statement on the website of the organisation.
Do you not receive a response from this person either? Or are you not satisfied with the response? What you can do then depends on whether it concerns a company or a governmental organisation:
- Company: You can submit a complaint to the AP. Or initiate application proceedings with the court.
- Governmental organisation: You can submit a complaint to the AP. Or give the governmental organisation notice of default because of failure to give a timely decision. Do you not receive a response within 2 weeks after having given notice of default? Then you can lodge an appeal because of failure to give a timely decision with the administrative court.
