Camera use in and around the home

To secure your property, you are permitted to install a camera at your home or use a doorbell camera. Generally speaking, you are not permitted to film public roads or your neighbours. This is only permitted if you have a demonstrably good reason, such as if there have been a lot of burglaries in your neighbourhood recently. You are also required to inform people of your use of a camera.

Camera use & the GDPR

If you are a private individual and make camera recordings for domestic use, the GDPR does, in principle, not apply.

However, the GDPR does apply if you film parts of public spaces for security purposes. Or if you make the images available to an unlimited number of people, for example, on the Internet. In such cases, you need consent from the people you have filmed, among other things.

A housing association or owners’ association must also comply with the GDPR when installing a camera.

Providing camera images

The police may request or demand images from your camera. You must then comply with certain rules in the GDPR.

Complaints about cameras

The Autoriteit Persoonsgegevens (AP), the Dutch data protection authority, receives many complaints about cameras from neighbours. If you feel your privacy is being violated by someone else’s camera, you can take action yourself.
